These Terms and Conditions (“Terms”) govern your use of Skolika, including skolika.com, the dashboard, the public academy pages we host for you, and everything reachable from them (the “Service”). By creating an account or using the Service you agree to them in full. If you are agreeing on behalf of an academy, school or company, you confirm you are authorised to bind it, and “you” means that organisation.
1. What Skolika is
Skolika is software you subscribe to, used to run your own teaching business: enrolling students, building a timetable, holding live classes, recording attendance, keeping a record of payments, and publishing a public page in your name.
Skolika is not a marketplace, not a tutoring agency, and not a payment processor for your tuition. We do not sell lessons, do not introduce students to you, do not employ your teachers, and do not take a commission on what you charge. Your students’ money never passes through Skolika: you collect it directly, by whatever means you already use, and the Service only records what you tell it. Any agreement about lessons, fees, refunds or conduct is between you and your student or their family, and we are not a party to it.
2. Your account
You must give accurate registration details and keep them current. You are responsible for the confidentiality of your credentials and for everything done under your account, including by teachers, managers and staff to whom you grant access. Tell us promptly at info@skolika.com if you believe an account has been compromised.
An academy owner controls who holds a seat and what each seat can see. Granting someone access to student records, financial records or messaging is your decision, and you remain responsible for their use of it.
3. Your students, and what you are responsible for
Records you enter about your students — names, contact details, attendance, marks, notes and payment history — belong to you and are held by us on your behalf. In data-protection terms you are the controller of that information and we act as your processor. You confirm that:
- you have a lawful basis for entering each person’s details and for contacting them through the Service;
- where a student is a child, you have the consent of a parent or guardian, and you are responsible for obtaining and holding it;
- the phone numbers and email addresses you load are ones you are entitled to message;
- you will answer any request from a student or family about their own data, and we will help you do so.
Our own handling of that information is described in the Privacy Policy.
4. Text messaging (SMS)
Some academies on Skolika text their families. This section applies to every academy that switches the channel on, and to everyone who receives a message because of it. Two roles decide who is answerable for what:
- The academy is the sender. Messages go out from the academy’s own messaging account and its own number, in its own name. It decides who is on the list, what each message says, and when it is sent.
- Skolika is the software that delivers them. We do not write the messages, do not choose the recipients, and never text an academy’s families on our own initiative. The only texts that come from us are about your own Skolika account — a sign-in code, a security alert, a billing notice.
What is sent. Announcements, class schedules and reminders, closures and emergency notices, event notices, enrolment and fee information, and replies to a question you sent the academy.
How a number joins the list. By ticking the SMS consent box on a Skolika form, such as the contact form on this site; by switching SMS consent on in your own account settings, after confirming the number with the six-digit code we send to it; by giving your number and your consent to the academy directly — in person, on paper, or on a form it asks you to complete — which the academy records against your contact; or by texting the academy first.
Two kinds of message, two different bars. A message about something you already booked or enrolled in — a lesson reminder, a closure, a payment notice — is part of the service you asked for and needs no separate marketing opt-in. Anything promotional — a new course, an offer, an open day — is sent only to someone who gave an explicit opt-in on a number that has been confirmed by code. An opt-out stops both.
Message frequency varies, by academy and by time of year.
Cost. Message and data rates may apply. Neither Skolika nor your academy charges you for these messages; any charge comes from your own wireless carrier.
How to stop. Reply STOP to any message. You will receive one confirmation message and then no further texts from that academy. Reply START to opt back in. Because your choice is recorded here as well as at your carrier, the surest way to resume is to switch SMS consent back on in your Skolika account settings, or to ask the academy to record your consent again. Reply HELP for help, or use the contact details published on your academy’s Skolika page.
Consent is not a condition of enrolment, of admission, or of any purchase. Refusing texts, or stopping them later, changes nothing else about a student’s place at the school.
Carriers are not liable for delayed or undelivered messages.
Mobile information is not shared. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. How opt-in data is held and handled is set out in the Privacy Policy.
If you run an academy, switching the channel on makes you the sender of record, and you agree that:
- you obtained each recipient’s consent before texting them, and can produce a record of when and how it was given;
- every number you load is one you are entitled to message, and none of it was bought, rented or scraped;
- you identify your school by name in your messages and give a working way to reach a person;
- you honour a stop request straight away, by whatever route it reaches you — a reply, an email, a word at the door;
- you keep your own registration with the messaging and carrier networks accurate and current, including the name, address and contact details you registered under;
- you do not use the channel for anything our Acceptable Use Policy forbids.
We may switch the channel off for an academy that breaks this, without suspending the rest of its account, because one school’s unconsented messages put every school on the platform at risk of being blocked.
5. Plans, billing and the free plan
- Subscriptions are priced per active teacher, per month. A teacher who holds no class in a billing month is not counted. Students are unlimited on every plan.
- The free plan is free indefinitely, requires no payment card and does not expire. Its limits are shown on the pricing page.
- Paid plans renew automatically at the end of each billing period until cancelled. You authorise us, and our payment processor, to charge your saved payment method for each renewal.
- Adding a teacher mid-period is charged pro rata; pausing one takes effect from the next period.
- Prices are shown before you subscribe. We may change them, but a change never applies to a period you have already paid for, and we will give at least 30 days’ notice by email before it affects your renewal.
- Taxes, bank charges and currency-conversion costs imposed by your own bank or card issuer are yours.
6. Cancellation and refunds
You can cancel at any time from your own settings, with no phone call and no notice period. Every paid plan carries a 90-day money-back guarantee. What that covers, how to claim it, and what happens to your data afterwards are set out in full in our Refund and Cancellation Policy, which forms part of these Terms.
To be clear about the one thing we cannot refund: tuition your students paid you is not ours to return. We never received it. Refunds to a student are a matter between you and that student.
7. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which forms part of these Terms. In short: do not use Skolika to break the law, to harm anyone, to send messages people have not agreed to receive, or to interfere with the Service itself.
8. Your content
Lesson material, notes, timetables, logos and anything else you upload remain yours. You grant us only the licence we need to operate the Service for you: to store your content, display it to the people you have given access to, back it up, translate the parts you ask to be translated, and transmit it as the Service requires. That licence ends when you delete the content or close your account, apart from copies held in routine backups until they expire.
You are responsible for having the right to upload what you upload. Do not upload material you do not own or have permission to use.
9. Third-party services
Parts of the Service depend on providers we do not control — among them Zoom and Google Meet for live classes, Google Calendar for scheduling, WhatsApp and email for reminders, and Stripe for subscription billing. Connecting one is your choice, and using it means accepting that provider’s own terms. We are not responsible for their availability, their pricing decisions, or the content of any external site linked from Skolika.
10. Availability, support and change
We work to keep the Service available and to give you notice before planned maintenance, but we do not promise it will be uninterrupted or error-free. We may add, change or remove features; where a change materially reduces a feature you rely on, we will tell you by email in advance. Support is provided by email and through the in-product channels shown in your dashboard.
11. Our intellectual property
The Skolika platform, its name, logo, design and software are ours or our licensors’. Your subscription grants a limited, non-exclusive, non-transferable right to use them for the term of your subscription and nothing more. You may not copy, resell, rent out, reverse-engineer or attempt to extract the source of the Service, or remove any notice of ownership from it.
12. Suspension and termination
We may suspend or close an account that breaches these Terms or the Acceptable Use Policy, that is used unlawfully, or that puts the Service or other users at risk. Where circumstances allow, we will warn you first and give you a chance to put it right. On termination you keep the right to export your data for 30 days, after which it is deleted as described in the Refund and Cancellation Policy.
You may stop using the Service at any time.
13. Disclaimers
The Service is provided “as is”. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any teaching, commercial or enrolment outcome, and nothing on our site is a promise that you will gain students or income.
14. Limitation of liability
To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill or data. Our total liability arising out of or relating to the Service in any twelve-month period is limited to the amount you actually paid us for the Service in that period. Nothing here limits liability that cannot lawfully be limited.
15. Indemnity
You agree to indemnify us against claims, damages and reasonable costs arising from your use of the Service in breach of these Terms, from content you upload, or from a dispute between you and a student, family, teacher or member of staff.
16. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. Disputes that cannot be settled informally will be resolved by binding individual arbitration under the Federal Arbitration Act, and you and we each waive the right to bring or join a class action. Either party may still bring an individual claim in small-claims court. If you are a consumer resident in a country whose law gives you rights that cannot be waived by agreement, this clause does not take them away.
17. Changes to these Terms
We may revise these Terms. If a change is material we will give notice by email or prominently in the product before it takes effect. Continuing to use the Service after that date means you accept the revised Terms; if you do not, you may cancel.
